- consultation
- developing and implementing safe work procedures
- training and supervision of employees
- reporting safety issues
- workers' compensation and return to work programs

  • the Serious About Safe Business Self-Assessment tool which provides businesses with a means of assessing their current level of safety compliance as well as accompanying guidance on how to lift safety performance to a higher level over six key result areas

  • a follow-up site visit by a health and safety professional to help workshop participants apply the principles learned back in the workplace while at the same time developing a plan for improvement (this component alone is valued at over $400)

  • ongoing support and advice from the ACT OHS Commissioner's Office throughout the duration of the program

  • a Certificate of Achievement and window decal for those businesses progressing through to implementation of safety improvements.

DANGEROUS OR DEFECTIVE VEHICLES

In this article we look at options that you could take where you have a vehicle that appears unsafe/dangerous or defective.  This includes a recommendation to consider notifying the police. (However, please be aware the consumer has the right to seek an independent advise)

Where you find problems with a vehicle that relate to safety, or you consider that the  vehicle could be defected, we suggest that you consider the following steps:

  • record the items on the job card and notify the customer about the issues, and seek authorisation to repair or fit replacement items;
  • where authorisation is not given, and you still consider that there is a safety issue with driving the vehicle, let the customer know that you consider it is unsafe to drive the vehicle without such repairs or replacement;
  • note the safety items on the invoice, and report this in writing to the customer when they pick up the vehicle;
  • ask the customer to sign to indicate that they have been advised, and that they have declined to authorise the recommended work;
  • if the customer refuses to do this, make a note on your copy of the invoice to the effect that you advised the customer and they refused to sign acknowledgement.

 Repairers have the right to report a defective vehicle and the web link below is available to anyone to report a defective vehicle on the ACT Government ACT Rego web site or alternatively contact the MTA for a form to be faxed to your business.

 This general advice is provided by way of minimising the risk of claims against a workshop.  It is practical in nature, and is not a substitute for individual legal advice.

EMPLOYMENT RELATIONS UPDATE

DAYLIGHT SAVING COMMENCES

Members please be advised that daylight saving commences on Sunday 5 October 2008, at 2am when clocks are put forward one hour.  Any members who employ employees on a shift work basis please be aware that for the purposes of payment for time worked during this period.  Employees should be paid based on the difference of time represented by the clock at the beginning of the shift and the clock time at the end of the shift.

LABOUR DAY PUBLIC HOLIDAY

The Labour Day public holiday falls on Monday 6 October 2008, this holiday applies to all employees.

Members should be aware that all work done on a public holiday, generally incurs a penalty rate of double time and one half, except for full time console operators and driveway attendants which are paid at the rate of double time.  The rate for Motor Vehicle Salesman is based on award rate of pay and not their actual rate (half of the award rate if more than half a day is worked and one quarter of the award rate if less than half a day is worked).

Members can reach agreement with their staff to substitute the Labour Day holiday for another day.  If members choose to do this, all time worked on Monday 6 October will be paid at normal time and another paid day off will be given to employees at a later date.
